Privacy Policy

Effective date: October 1st, 2016

Kabinett is a digital platform for sharing music, photos, videos and stories related to the arts. Content uploaded by users sees the opportunity to be featured on Kabinett's newsletter, a focus point where the most desirable posts are curated for public enjoyment. Users of the app upload posts that are unique to them and relate to their interests and passions. Just snap a photo, choose a filter, write a title and a short text and share it with Kabinett and your friends.

This policy (“Privacy Policy”) sets out our privacy practices and explains how we handle the information we collect when you visit and use our sites, services, mobile applications, products, and content (“Services”). Our Privacy Policy applies to all visitors, users, and others who access the Service ("Users").

By using our Services, you understand and agree that we are providing a platform for you to post content, including photos, text, comments and other materials ("User Content"), to the Services and to share User Content publicly. This means that other Users may search for, see, use, or share any of your User Content that you make publicly available through the Services, consistent with the terms and conditions of this Privacy Policy.

Kabinett does not claim ownership to any materials or content uploaded by Users as the app is a public sharing hub to exchange information. Kabinett does not claim ownership of any content uploaded onto the newsletter as it is means for the app to curate the most popular posts. Any content that is plagiarized or stolen shall be promptly removed from Kabinett.

INFORMATION WE COLLECT

We collect the following types of information.


Information you provide us directly:

_      Your username, password and e-mail address when you register for a Kabinett account.

_      Profile information that you provide for your user profile (e.g., first and last name, picture, phone number, website and Bio). This information allows us to help you or others be "found" on Kabinett.

_      User Content (e.g., photos, texts, comments, and other materials) that you post to the Service.

_      When you create your Kabinett account, and authenticate via a third-party service like Facebook, we may collect, store, and periodically update the contact lists associated with that third-party account, so you can connect with existing contacts from that service who are on Kabinett.

_      Sometimes we’ll send administrative emails about account or service changes, or new policies. You can’t opt out of them. You can always opt out of non-administrative emails such as newsletters

_      We won’t email you to ask for your password or other account information. If you receive such an email, send it to us so we can investigate.

Analytics information:

We use third-party analytics tools to help us measure traffic and usage trends for the Services.

Log file information:

_      Your browser automatically reports log file information each time you make a request to access (i.e., visit) a web page or app. It can also be provided when the content of the webpage or app is downloaded to your browser or device.

_      When you use our Services, our servers automatically record certain log file information, including your web request, Internet Protocol ("IP") address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Services, domain names, landing pages, pages viewed, and other such information. We may also collect similar information from emails sent to our Users which then help us track which emails are opened and which links are clicked by recipients. The information allows for more accurate reporting and improvement of the Services.

Metadata:

_      Metadata is usually technical data that is associated with User Content. For example, Metadata can describe how, when and by whom a piece of User Content was collected and how that content is formatted.

_      Users can add or may have Metadata added to their User Content including a hashtag (e.g., to mark keywords when you post a photo), geotag (e.g., to mark your location as user), comments or other data. This makes your User Content more searchable by others and more interactive. If you geotag your photo or tag your photo using other's APIs then, your latitude and longitude will be stored with the photo and searchable (e.g., through a location or map feature) if your photo is made public by you in accordance with your privacy settings.

Payment information:

_      If you make a purchase in the Services, Kabinett may collect the billing and financial information necessary to process the charges; and/or do so on behalf of the relevant payment service providers. Purchases of third party services are subject to the policies applicable to the third parties.

 

HOW WE USE YOUR INFORMATION


In addition to some of the specific uses of information we describe in this Privacy Policy, we may use information that we receive to:

_      help you efficiently access your information after you sign in

_      remember information so you will not have to re-enter it during your visit or the next time you visit the Service;

_      provide, improve, test, and monitor the effectiveness of our Services;

_      develop and test new products and features;

_      monitor metrics such as total number of visitors, traffic, and demographic patterns.

SHARING OF YOUR INFORMATION


We will not rent or sell your information to third parties outside the company without your consent, except as noted in this Privacy Policy.

We may share your personal information with third parties in limited circumstances, including: (1) with your consent; (2) to a vendor or partner who meets our data protection standards; or (3) when we have a good faith belief it is required by law, such as pursuant to a subpoena or other legal process.

If we’re going to share your information in response to legal process, we’ll give you advance notice so you can challenge it (for example by seeking court intervention), unless we’re prohibited from doing so by law or court order. We will object to requests for information about users of our site that we believe to be improper.

We may cooperate with government and law enforcement officials and private parties to enforce and comply with the law.  We may access, read, preserve, and disclose your information, to government or law enforcement officials or private parties if, in our sole discretion, we believe it is necessary or appropriate in order to (i) satisfy any applicable law, regulation, legal process or governmental request (including court orders and subpoenas), (ii) investigate potential violations of, or enforce, our Terms of Service, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, (v) protect the safety, property, or rights of our company, our users, or of any third party, or (vi) prevent or stop any illegal, unethical, or legally actionable activity.

If we merge with another company such that your information will become subject to a different privacy policy, we’ll notify you before the transfer. You can opt out of the new policy by deleting your account during the notice period.

Subject to your profile and privacy settings, any User Content that you make public is searchable by other Users and subject to use under our Kabinett API. The use of the Kabinett API is subject to the Terms of Service which incorporates the terms of this Privacy Policy.

If you remove information that you posted to the Services, copies may remain viewable in cached and archived pages of the Service, or if other Users or third parties using the Kabinettt API have copied or saved that information.

You may allow the Services to interact with third-party service like Facebook, which  may provide data about you to Kabinett. These social networks and/or platforms, or any similar third-party applications or websites, are owned by a third parties and not by Kabinett. You must ensure that you read their terms of service and the applicable privacy policies. You understand that when you allow the Services to interact with any third party social network and/or platform, Kabinett may share data about you with your contacts and other users of the Services, and vice versa. This data may include your name, profile picture, activity and status, and use of the Services. You may be able to change this by adjusting your settings with that third-party provider.

Any information or content that you voluntarily disclose for posting to the Services, such as User Content, becomes available to the public. Once you have shared User Content or made it public, that User Content may be re-shared by others.

Kabinett may share your payment information with third-party payment processors in order process payments and purchases that you have authorized.

HOW WE STORE YOUR INFORMATION

Kabinett uses third-party vendors and hosting partners, such as Amazon and Mydomain, for hardware, software, networking, storage, and related technology we need to run Kabinett.

YOUR CHOICES ABOUT YOUR INFORMATION

Your account information and profile/privacy settings:

_      Update your account at any time by logging in and changing your profile settings.

_      Unsubscribe from email communications from us by clicking on the "unsubscribe link" provided in such communications. As noted above, you may not opt out of Service-related communications (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of the Service, technical and security notices).

 

_      Delete information from your profile and de-link your Facebook account you’re your profile.

_      To protect information from accidental or malicious destruction, we may not immediately delete residual copies from our active servers and may not remove information from our backup systems.

_      If you delete your account, your account and content may be unrecoverable.

However, information that you have shared via the Services on any social network or third party platform may not be amended or deleted where it is in the control of a third-party network and/or platform.

Please note that most of the user content that appears on our Services is stored and controlled by third party providers or by other users; thus, complete and comprehensive removal of the content may not be possible. 

PROTECTION OF INFORMATION


Kabinett maintains appropriate technical and physical safeguards to protect information against accidental or unlawful destruction or loss, alteration, unauthorized disclosures or access, and any other unlawful forms of processing of the data in its possession. However, no data storage or transmission over the Internet or other network can be guaranteed to be 100% secure. Accordingly, Kabinett does not guarantee that information will not be accessed, disclosed, altered or destroyed by breach of any of the abovementioned safeguards.

INTERNATIONAL TRANSFER


Your information may be transferred to, and maintained on, computers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you’re located outside the United States and choose to provide your information to us, we may transfer your information to the United States and process it there. Whenever we transfer your information outside of the jurisdiction in which you are located, we ensure that appropriate safeguards are in place in relation to maintaining its security. Irrespective of which country you reside in or supply information from, you authorize Kabinett to store and/or use the information according to this Privacy Policy in any country where Kabinett may operate.

LINKS


In the Services, you may find links to third party websites. You understand that when you click on these links any data which you provide afterwards is subject to that third party's privacy policy and not to Kabinett’s. Consequently, Kabinett takes no responsibility for the content, safety or security of any third-party website.

CHILDREN PRIVACY


The Services are not directed to persons under the age of 13. Kabinett does not knowingly collect any information from children under the age of 13. If you become aware that a child under the age of 13 has provided with personal information, steps will be taken to remove such information and terminate such account. If you become aware that any child has provided personal information without the essential legal guardian consent, please contact us.

GENERAL TERMS


Notwithstanding anything to the contrary in this Privacy Policy, Kabinett may preserve or disclose your information to the extent reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect Kabinett's rights or property. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s request to disclose your information.

If any court or other competent authority finds any of this Privacy Policy to be invalid or unenforceable, the other terms of this Privacy Policy will not be affected.

CHANGES TO OUR PRIVACY POLICY


Kabinett may revise or amend this Privacy Policy from time to time.  If we decide to change this Privacy Policy, we will inform you by posting the revised Privacy Policy on the site. The most current version of the policy will govern the use of the information and will be at www.wearekabinett.com/privacy_policy/. Kabinett may also, but is not required to, notify you of changes to the Privacy Policy via email to the email address associated with your account.

If you object to any of the changes to the Privacy Policy, you should immediately stop using the Services and close any related accounts related. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.
